The Legal System in Malta

The Maltese legal system has been moulded by the influence received during the long years of colonial rule from various legal cultures which today form part of Malta’s history. This has resulted in the Maltese legal system to become a mixed legal system. Its roots comprise of Roman Law (continental) and British Law which is a worthy example of early attempts aimed at fusing together two great families of law.

Law in Malta evolved further especially with the foundation of a Maltese parliament in 1921 and furthermore after Malta gained independence in 1964. Significant developments to the Maltese legal system were also brought about by the country joining the European Union (EU) in 2003. As an EU member state, Malta transposed the EU Treaty into Maltese law, meaning that EU law became the law of the country.
